Legal—Terms of Service

Leads asa product.

The terms that govern our lead generation, AI follow-up and reactivation services — including what we guarantee, what we do not, and what you represent when you hand us a list.

Nature of the service

GrowthPros provides lead generation, lead qualification, AI-driven follow-up and dead-lead reactivation services. Leads are sold on an exclusive, capped-shared or shared basis per agreement. Pricing is set per program following a qualification call; any figures shown on the site are directional industry benchmarks, not offers or guarantees of results.

Leads are sold via qualification call

For the current version of the service there is no self-serve marketplace or instant checkout. Volume, exclusivity and per-lead pricing are confirmed on a call before any program begins, and any lead volume we quote is a good-faith estimate based on niche, geography and seasonality rather than a contractual guarantee of delivery volume.

No guarantee of outcomes

We deliver qualified, consent-recorded leads and follow them up inside the promised window. We do not guarantee that any lead will close, and we are not responsible for factors outside our control — including your sales process, pricing, product fit or the buyer’s own circumstances. Case studies and benchmarks shown on the site are illustrative of what the levers can do, not promises of your results.

Client responsibilities for reactivation

When you provide a list for reactivation, you represent that the contacts on it have a pre-existing, opted-in relationship with your business and that you have the right to have them contacted. You remain responsible for the lawfulness of the underlying consent. We scrub records against Do-Not-Call registers before contact and honor opt-outs, but the original consent basis is yours to stand behind.

Compliance cooperation

We store the disclosure text, timestamp, IP and named contacting party for every lead we process, and we make those records available to you on request so you can substantiate your own position. Any dispute, claim or regulatory inquiry arising from outbound contact will be handled with your cooperation and the records made available.

TCPA and regulatory exposure

Telephone Consumer Protection Act violations can carry statutory penalties of $500 to $1,500 per call or text, and class actions in this area regularly reach eight figures. Regulatory requirements are in flux. Nothing in these terms constitutes legal advice, and you are encouraged to obtain your own legal review of any outbound program before scaling it.

Payment and cancellation

Payment terms are set in the program agreement confirmed on the qualification call. Monthly volume programs can be cancelled with notice as specified in that agreement; reactivation campaigns that have already commenced are billed for work performed.

Limitation of liability

To the maximum extent permitted by law, GrowthPros and the AIQ Labs family companies are not liable for indirect, incidental or consequential damages arising from the service, and aggregate liability is limited to the fees paid for the program in question. This does not exclude liability that cannot be excluded by law.

This document is provided for information only and is not legal advice. Given TCPA and FCC exposure, all consent, outreach and data practices described here should be reviewed by your own counsel before any program at scale. Questions: [email protected]. See also our Privacy Policy.
